Terms of Use

1. Acceptance of Terms

By accessing or using Folex Auto Market ("the Platform", "we", "us"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Platform. These terms apply to all visitors, buyers, sellers, dealers, and any other user of the Platform.

2. Marketplace Role

Folex Auto Market is a marketplace platform that connects buyers with sellers and dealers of vehicles in Nigeria. We are not the owner, seller, buyer, or legal holder of any vehicle listed on the Platform. We do not take title to any vehicle and are not party to any transaction between users. We do not guarantee the accuracy of any listing, the identity of any user, or the condition of any vehicle unless explicitly marked as Verified or Inspected by our team.

3. Buyer Responsibilities

Buyers must: (a) carry out reasonable due diligence before making any payment or deposit; (b) inspect any vehicle in person before purchase where possible; (c) verify ownership documents, customs papers, roadworthiness certificate, and vehicle licence before committing to purchase; (d) check the VIN/chassis number against official records; (e) not make blind deposits to sellers they have not verified; (f) report suspicious listings using the Report feature. Folex Auto Market is not liable for losses arising from transactions between buyers and sellers.

4. Seller Responsibilities

Sellers must: (a) provide accurate and truthful vehicle descriptions, including correct mileage, condition, year, and specification; (b) own or have legal authority to sell any listed vehicle; (c) hold valid ownership documents; (d) respond to buyer enquiries promptly and honestly; (e) mark listings as sold when a vehicle is no longer available; (f) comply with Nigerian consumer protection laws. Sellers are solely responsible for completing vehicle sales and transferring ownership legally.

5. Dealer Responsibilities

Dealers must comply with all Seller responsibilities above, and additionally: (a) maintain an active, valid dealer registration or business licence; (b) ensure their dealership details on the Platform are accurate; (c) not list vehicles they do not own or have legal authority to sell. Dealer Pro is a subscription tier available to dealers — it is not a separate account type. Dealer Pro accounts must enable Two-Factor Authentication (2FA) as a security requirement.

6. Listing Accuracy

All listings must accurately describe the vehicle being offered. Prohibited inaccuracies include: false mileage, incorrect year, undisclosed accident damage, misleading photos (including stock or manufacturer images), false ownership claims, and incorrect condition categorisation. Listings found to be materially inaccurate will be removed. Repeated violations may result in account suspension.

7. Prohibited Listings

The following are prohibited on the Platform: (a) stolen vehicles; (b) vehicles with altered or forged documentation; (c) vehicles under finance with undisclosed encumbrances; (d) non-road-legal vehicles listed as road-ready; (e) vehicles listed at fraudulently low prices to attract scam deposits; (f) duplicate listings of the same vehicle; (g) listings for vehicles not physically available in Nigeria; (h) any listing designed to deceive buyers.

8. Fraud and Suspicious Activity

Folex Auto Market reserves the right to suspend, remove, or permanently ban any account involved in fraudulent activity, including but not limited to: fake listings, stolen vehicle sales, identity fraud, payment scams, requesting payments outside the Platform, threatening or abusive behaviour, and submitting false fraud reports. Fraud evidence including reports, documents, communications, and records may be retained indefinitely for legal and audit purposes.

9. Payments and Subscriptions

Sellers and dealers pay subscription fees to list vehicles. All subscription plans renew monthly where auto-renew is enabled. Cancelling a subscription will keep the account active until the end of the current billing period. After the billing period ends, listings above the Basic plan allowance (1 active listing) will be paused — not deleted — until the seller renews or upgrades. Payment processing is handled by Paystack; amounts are charged in Nigerian Naira. Folex Auto Market does not store card details.

10. Listing Plans

Active listing limits apply to published, approved listings only. Sold, expired, paused, rejected, and draft listings do not count toward the active listing limit. If a payment fails, excess listings above the plan limit will be paused. Listing plan features, pricing, and limits are described on the Pricing page and may be updated with notice.

11. Account Suspension

Folex Auto Market may suspend, restrict, or terminate accounts that: (a) violate these Terms; (b) engage in fraudulent or misleading conduct; (c) receive multiple verified fraud reports; (d) post prohibited content; (e) harass, threaten, or abuse other users. Where possible, we will notify users of suspension and allow time to appeal. In cases of serious fraud or safety risk, accounts may be suspended immediately without prior notice.

12. Vehicle Inspections and Documents

Sellers and dealers may optionally upload vehicle documents (proof of ownership, customs papers, roadworthiness certificate, insurance, vehicle licence) for admin review. These documents are private and not displayed publicly. Admin-verified listings receive a Verified badge. Folex Auto Market does not independently guarantee document authenticity and recommends buyers conduct their own verification.

13. User Conduct

Users must not: (a) use the Platform for any unlawful purpose; (b) impersonate other users or third parties; (c) attempt to access other users' accounts; (d) upload malicious files or code; (e) scrape, copy, or reproduce Platform content without permission; (f) interfere with Platform operations. Violations may result in immediate account termination.

14. Intellectual Property

All Platform content, design, code, trademarks, logos, and branding are the property of Folex Auto Market or its licensors. Vehicle photos and descriptions are the property of the seller/dealer who submitted them. Users grant Folex Auto Market a non-exclusive licence to display submitted content on the Platform for the purpose of operating the marketplace.

15. Limitation of Liability

To the maximum extent permitted by Nigerian law, Folex Auto Market is not liable for: (a) any transaction between buyers and sellers/dealers; (b) losses arising from inaccurate listings; (c) vehicle defects discovered after purchase; (d) fraudulent activity by third parties; (e) service interruptions; (f) data loss. Our total liability for any claim shall not exceed the amount of subscription fees paid by the user in the 3 months preceding the claim.

16. Disputes

Disputes between buyers and sellers are the responsibility of the parties involved. Folex Auto Market may assist with mediation where possible but is not obligated to do so. These terms are governed by the laws of the Federal Republic of Nigeria. Any dispute not resolved amicably shall be referred to the courts of Lagos State, Nigeria.

17. Changes to Terms

Folex Auto Market may update these Terms at any time. We will notify users of material changes by email or platform notification. Continued use of the Platform after changes constitute acceptance of the updated Terms. The current version and effective date are shown at the top of this page.
